New US sanctions on the ICC: why they matter for Afghanistan

The United States has imposed sweeping new sanctions on the International Criminal Court (ICC) in a move that drew condemnation from the court and a number of international partners. With investigations involving Afghanistan, the move also has implications for war victims and the Afghan community.

According to a report by Reuters on 9 October 2026, the new US measures are affecting the International Criminal Court’s work. The court has warned that such measures could threaten its ability to fulfil its mandate and has urged member states to support its operations and independence.

The International Criminal Court, based in The Hague in the Netherlands, prosecutes some of the most serious international crimes. In recent years, its work has included cases and investigations into allegations of international crimes committed in Afghanistan.

The dispute between the United States and the ICC therefore has significance beyond distant diplomatic tensions. For victims of decades of war in Afghanistan, international accountability mechanisms have been among the few avenues available for examining allegations of serious crimes at an international level.

The new sanctions do not mean that investigations involving Afghanistan have automatically stopped or that Afghanistan-related cases have been closed. The available information does not support that conclusion. The central concern at present is how US restrictions may affect the court’s operational capacity and its ability to continue its work.

Developments involving the ICC are particularly significant for the Afghan community in Australia, especially war victims and families seeking accountability for serious human rights violations. The practical impact of the new sanctions on Afghanistan-related investigations will require monitoring as events unfold.
